ThriveX Active Shoulder Accelerator Online Course & Coaching Agreement
1. Introduction
This Agreement is made between Liberty Physical Therapy LLC, DBA Liberty Physical Therapy & Performance (“Provider”) and the participant (“Client”). By enrolling in the ThriveX Active Shoulder Accelerator online course, the Client agrees to the terms and conditions outlined in this Agreement.
2. Scope of Services
The Provider offers a self-guided online course and weekly group coaching sessions focused on shoulder performance. These services are educational and are not a substitute for professional medical advice, diagnosis, or treatment.
3. Cross-State Operations
The Client acknowledges that the Provider may operate across state lines and agrees that this Agreement is governed by the laws of the state in which the Client is based.
4. Client Responsibilities
● The Client agrees to consult their healthcare provider before starting the course or participating in group coaching sessions if possible safety concerns are present.
● The Client acknowledges that the course and coaching are not physical therapy or medical treatment.
5. Risk Acknowledgment
The Client understands and accepts all risks associated with participating in the course and coaching sessions. The Client agrees to hold the Provider harmless from any claims or damages arising from their participation.
6. Payment and Refund Policy
We are confident that you will find value in the ThriveX Active Shoulder Accelerator course. However, if you are not satisfied, we offer the following refund policy:
1. 14-Day Money-Back Guarantee:
○ If you are not satisfied within the first 14 days of enrollment, you may request a full refund.
○ To be eligible, you must demonstrate that you have engaged with the course material (e.g., completed at least 3 modules and attended 1 coaching session).
2. Partial Refunds:
○ After 14 days and up to 30 days from enrollment, you may request a 50% refund.
○ No refunds will be issued after 30 days from enrollment.
3. Credits for Future Use:
○ If you are not eligible for a refund, you may request credits to be used for other services or future courses offered by Liberty Physical Therapy LLC.
4. Non-Refundable Fees:
○ The total cost of the course is non-refundable after 30 days.
○ Lifetime access to the course and its updates, 12 months of weekly coaching calls, and access to the community/support are included in the course fee.

7. Confidentiality
The Provider agrees to protect the confidentiality of the Client’s personal information. The Client’s information will not be shared with third parties without their consent, except as required by law.
8. Intellectual Property
All materials provided in the course are the intellectual property of the Provider. The Client agrees not to reproduce, distribute, or share these materials without the Provider’s written consent.
9. Limitation of Liability
The Provider’s liability is limited to the amount paid by the Client for the course. The Provider is not liable for any indirect, incidental, or consequential damages.
10. Jurisdiction
This Agreement is governed by the laws of the state in which the Provider is based. Any disputes arising from this Agreement will be resolved in the courts of that state.
11. Entire Agreement
This Agreement constitutes the entire agreement between the Provider and the Client. Any modifications to this Agreement must be made in writing and signed by both parties.
By enrolling in the ThriveX Active Shoulder Accelerator online course, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Agreement.
